While your credit card information, such as bank details, debit card or credit card number, expiration date, and CVV code, may be processed during the sale, LC Waikiki does not store these data. LC Waikiki processes your limited financial information, such as the last 4 digits of your card number, for the specific purposes specified below, including the storage of sales records and fulfilling requests related to returns and exchanges in accordance with relevant legislation

C. Purposes and Legal Grounds for Processing Personal Data

Your personal data are processed pursuant to the general principles set out in Article 4 of the Law, in accordance with the law and good faith, accurate and, where necessary, up-to-date, for specific, explicit, and legitimate purposes, in connection with the purpose for which they are processed, limited and proportioned, and stored for the period stipulated by relevant legislation or required for the purpose for which they are was processed.

Your collected personal data may be processed for the purposes set out below (“Purposes”) within the personal data processing the conditions and purposes specified in Article 5 of the Law.

Based on legal ground that processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract;

Presenting our Company’s products and services to you through our physical stores, website, and mobile application channels, as well as performing sales transactions
Providing you with services through our Company’s www.lcwaikiki.com.tr electronic marketplace platform (“the Platform”), facilitating the sales of products and services offered by sellers on the Platform through our Company (third parties who publish advertisements for their products/services on the Platform and offer their products and services for sale on the Platform through our Company will hereinafter be referred to as “Sellers”), providing electronic invoicing services as part of easy invoice tracking, engaging in communication activities related to the Platform, offering special advantages and offers as part of the Platform, providing information about your transactions on the Platform, carrying out communication activities upon request, carrying out and completing the order, delivery and cargo processes of the products you have purchased from the Sellers and providing relevant information and communication, providing mediation and support services in the return process if you choose to return products purchased from Sellers through our Company’s stores, performing the return acceptance evaluation and return form processes, and carrying out the necessary procedures for the completion of the return process before the relevant Seller,
Establishing sales contracts for our Company’s products and services, as well as performing invoicing transactions,
Executing and completing orders, order and delivery processes, and communication with our customers through online services,
Fulfilling after-sales support services and warranty processes,
If a membership is created, creating membership accounts and executing membership transactions through the website or our mobile application; performing member account closure/deletion actions,
If a membership is created, verifying you are old enough to shop on the website or mobile application,

Based on legal ground that it is expressly provided for by the laws and it is necessary for compliance with a legal obligation to which the data controller is subject.;

Fulfilling the legal obligations to which our Company is subject, especially the Law on the Protection of Consumers, the Law on the Regulation of Retail Trade, and the Law on the Regulation of Electronic Commerce,
Providing information to authorized institutions in accordance with legislation and fulfilling requests from official institutions,
Ensuring compliance with the retention obligations stipulated in the legislation,
Ensuring that your information is up to date and accurate,
Evaluating the applications you have submitted to the Company within the scope of exercising your rights specified in Article 11 of the Law regarding your personal data processed by our Company, finalizing these evaluations in accordance with the legislation and taking the necessary action,
Within the scope of our Platform services; conducting necessary controls and keeping records to ensure the proper execution of distance contracts and preliminary information requirements, confirmation and verification of the said execution, ensuring completeness and accuracy of mandatory information when data entry is undertaken by the Company, carrying out the necessary controls and keeping records in the processes of ensuring compliance with the information promised in advertisements and promotions made through the Platform; performing notification and return processes in cases where the Seller is unable to fulfill the performance of the goods ordered; operating a system for you to submit and track your requests and notifications, forwarding them to the relevant Seller as per Article 12/A of the Distance Contracts Regulation; operating a system on the Platform for you to submit your withdrawal notifications; forwarding your notifications to the relevant Seller in case you first submit them to our Company, performing confirmation and return processes in certain cases; if commenting is available on the Platform, matching and/or verifying the commenter with the person who purchased the product/service to ensure that comments are relevant and made only for the purchased item/service according to comment policies; informing you about the publication or non-publication of your comments on the Platform.

Based on legal ground that data processing is necessary for the establishment, exercise or protection of any right;

Receiving, evaluating, and finalizing your requests and complaints, managing customer relations and providing digital assistance services,
Storing personal data during general period of limitation to serve as evidence in the follow-up and execution of legal matters and potential future disputes.

Based on legal ground that processing of data is necessary for the legitimate interests by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject;

D. Parties to Whom Processed Personal Data May be Transferred and Purpose of Transfer

Your collected personal data for the Purposes mentioned above may be transferred to the following parties in accordance with the data processing conditions regulated in Articles 5 and 6 of the Law, and the rules regarding the transfer of personal data specified in Articles 8 and 9 of the Law:

to suppliers (cargo companies, call center, research firms, advertising agencies, etc.) and other technical service providers (infrastructure, database management, etc. service providers), our business partners, group companies, subsidiaries, and shareholders to whom we provide services as part of our legitimate interests,
in case you have a Chippin membership, and you choose to use this membership when shopping, to Tanı Pazarlama ve İletişim Hizmetleri A.Ş., the provider of the Chippin program,
in the event of a demerger or transfer of all or part of the Company to another entity, to the company to which the Company’s relevant assets will be transferred, for the purpose of guaranteeing the results arising from these legal transactions.
to legally authorized public authorities and legally authorized private individuals in accordance with the explicit provisions of the laws and to fulfill our legal obligations,
if you benefit from our "Buy for Me" service within the scope of providing our Company's products and services to you through our mobile application, in order to carry out the sales and delivery processes, (i) your name, contact, delivery address and bag information you provide will be shared with the person of you wish to make the purchase as per your decision and (ii) if you are the person making the purchase, your name, contact, billing address, product information you purchased and payment method will be shared with the person to whom the products will be delivered,
if you provide explicit consent, your identity and contact data may be transferred to WhatsApp LLC, a foreign-based service provider, for the purposes of providing after-sales support services, evaluating, and resolving your requests and complaints, managing customer relationships, and providing digital assistance services, via Whatsapp platform.
if you provide explicit consent, your identity, contact and customer transaction data may be transferred to our supplier Mindbehind Bilgi Teknolojileri A.Ş., who hosts personal data outside of Türkiye, for the purposes of providing after-sales support services, evaluating, and resolving your requests and complaints, managing customer relationships, and providing digital assistance services, via chatbot available at our Platform and mobile application,
if you provide explicit consent, your identity and contact data and your store visit evaluation record (and your contact permission, if provided) may be transferred to Question Pro Inc., our foreign-based service provider, for the purposes of receiving and processing your store visit evaluation.

E. Personal Data Collection Method

Your collected personal data may vary depending on the services, products, or commercial activities provided by LC Waikiki or the content of the contract established between you and us; this data may be collected in physical environment through verbal or written means by automatic or non-automatic methods, by sales stores, offices, or branches, data may be collected through interviews and forms when engaging with LC Waikiki; in the electronic environment through the Platform, call center, website, social media channels, communication applications, mobile applications, and online forms, such as membership and sales forms, and comment areas are also used for data collection.

F. What are the Rights of Data Subjects under the Law?

We would like to inform you that pursuant to Article 11 of the Law, as data subject you have the following rights:

Learn whether your personal data is processed or not,
Request information if your data is processed,
Learn the purpose of the processing of your personal data and whether they have been used accordingly
Learn which third parties domestic or abroad your personal data is transferred to,
Request the rectification of the incomplete or inaccurate data, if any, and to request the notification of such transaction to third parties to whom your personal data has been transferred to,
Request the erasure or destruction of personal data although it has been processed in accordance the Law and the provisions of other laws in the event that the reasons requiring their processing cease to exist, and to request the notification of such transaction to third parties to whom your personal data has been transferred,
Object to any negative consequences against you as the data subject since the processed data was exclusively analyzed by automated systems,
Request compensation for the damages that you have suffered as a result of an unlawful processing of your personal data.
